Terms of Use

Encounter+ (the “App”) and this website are made available to you by QBIT, s.r.o. (“QBIT”, “we”) subject to these Terms of Use, including our Privacy Policy. By downloading or using the App, you agree to be bound by these Terms. If you do not agree with them, please do not use the App.

We may update these Terms from time to time; the current version is always on this page. We may also change, suspend or discontinue the App or any part of it, and we are not liable to you or to anyone else for doing so.

The App is not directed at children under 9 years of age.

Licence

We grant you a personal, non-transferable, non-exclusive licence to use the App on devices you own or control.

You may not sell, rent, lease, sublicense or redistribute the App, and you may not reverse engineer, decompile or disassemble it, or attempt to derive its source code, except to the extent that applicable law expressly permits it. You may not circumvent, disable or interfere with any purchase or licence check in the App.

Purchases

Encounter+ is free to download and free to run a complete game. Two optional purchases are offered:

• Battle Map — a one-time purchase that permanently unlocks the battle map features.
• Premium — an optional monthly or yearly subscription that adds further features and supports ongoing development.

All purchases are made through the App Store and handled by Apple. Apple takes your payment; we never receive or store your payment details. Purchases are tied to your Apple Account rather than to a device, and can be restored on your other devices.

A subscription renews automatically at the end of each period until you cancel it. You can cancel, or turn off automatic renewal, in your Apple Account settings; cancellation takes effect at the end of the current billing period. When a subscription ends, subscription-only features become unavailable, but anything you bought outright remains yours and nothing you created is deleted.

Prices are set and displayed by the App Store in your local currency and may change. Refunds are handled by Apple under Apple’s policies, not by us — see reportaproblem.apple.com.

Your content

The App stores your content on your own device. We do not host it, receive it, review it or back it up. You are solely responsible for your content, including keeping your own backups of it.

You are responsible for having the right to use anything you import into the App — maps, images, compendiums, modules, game systems and other material. Do not import or distribute material that infringes anyone’s copyright, trademark or other rights, and do not use the App for anything unlawful.

If you share content you created with other people, you do so directly. We are not a party to that exchange and take no responsibility for it.

Remote play

The App can run a web server so that players can connect from a browser. When you enable it, you are operating that server on your own network, and doing so is your responsibility — including any router or port-forwarding changes you make, and who you give access to. Connections run directly between your device and your players. The feature is provided as-is, and network conditions outside our control may affect it.

Game systems and third-party material

Encounter+ is not tied to any single ruleset, and game systems can be installed or written by anyone. Game systems, modules and other content produced by third parties are the responsibility of whoever made them. We do not endorse, verify or take responsibility for third-party content.

QBIT is not affiliated with, endorsed by or sponsored by any game publisher. Trademarks and material belonging to publishers or other third parties remain the property of their owners.

Proprietary rights

The App and its software are protected by intellectual property laws. Except as these Terms allow, you may not copy, modify, distribute, publish, create derivative works from or commercially exploit any part of the App.

The name Encounter+, the Encounter+ logo and other QBIT names and logos are trademarks of QBIT, s.r.o., and may not be used without our prior written permission.

We reserve all rights not expressly granted here.

Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND. QBIT AND ITS AFFILIATES, EMPLOYEES, PARTNERS AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY ERRORS WILL BE CORRECTED.

Limitation of liability

TO THE EXTENT PERMITTED BY LAW, QBIT AND ITS AFFILIATES, EMPLOYEES, PARTNERS AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF DATA OR CONTENT, ARISING OUT OF OR CONNECTED WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.

Nothing in these Terms limits any rights you have as a consumer under the mandatory law of your country of residence.

Indemnity

You agree to indemnify and hold QBIT and its affiliates, employees, partners and licensors harmless from any claim or demand, including reasonable legal fees, arising out of content you import or distribute, your use of the App, or your breach of these Terms or of anyone else’s rights.

Termination

This licence ends if you breach these Terms, and it ends when you stop using the App or delete it. Provisions that by their nature should survive termination — including proprietary rights, disclaimers, limitation of liability and indemnity — continue to apply.

General

These Terms are the entire agreement between you and QBIT regarding the App. No joint venture, partnership, employment or agency relationship is created by them. Our failure to enforce any provision is not a waiver of it. If any provision is found invalid, the remaining provisions stay in effect. You may not transfer your rights under these Terms without our written consent; we may transfer ours. Section headings are for convenience only.
